Privacy Policy

Explorer Luggage is a trading name of EverMe Limited. We are committed to protecting your privacy and handling your personal information in accordance with the Privacy Act 2020.

This policy explains what we collect, why, who we share it with, and what rights you have. It applies to explorerluggage.co.nz and to any dealings you have with us as an Explorer Luggage customer.

1. What we collect

When you place an order, we collect your name, delivery address, email address and phone number. You do not need to create an account to purchase.

When you subscribe to marketing, we collect your email address. Date of birth is optional on one of our sign-up forms and is used only to send you a birthday offer.

When you contact us, we collect your name, contact details and the content of your enquiry.

When you visit the Site, our systems and analytics tools automatically record technical information including your IP address, device and browser type, the pages you view, time spent on those pages, referring website, and searches made on the Site.

We do not collect gender. We do not collect or store your full payment card details at any time.

2. Why we collect it

We use your personal information to:

process, fulfil and deliver your order;

communicate with you about your order and provide customer support;

handle returns, exchanges and warranty claims;

send you marketing communications where you have subscribed;

respond to your enquiries and feedback;

understand how the Site is used and improve our products, service and website; and

meet our legal and tax obligations.

Providing your information is voluntary, but we cannot process an order without the details needed to fulfil and deliver it.

3. Cookies and tracking technologies

We and our partners use cookies, pixels and similar technologies on the Site. These support essential site and checkout functionality, measure how the Site performs, and enable advertising on third-party platforms based on your activity on the Site.

We do not operate a cookie consent banner. These technologies operate when you visit the Site. You can control or block cookies through your browser settings, and you can opt out of personalised advertising through the settings offered by Google, Meta and TikTok. Blocking cookies may affect how parts of the Site function.

4. Advertising and analytics

We use Google Analytics and Google Ads, Meta (Facebook and Instagram) and TikTok to measure the performance of our marketing and to show advertising to people who have visited the Site.

Where we share customer data with these platforms for advertising measurement, identifiers such as your email address are hashed before transmission. Hashing obscures the underlying value but does not make the data anonymous, and we treat it as personal information.

5. Who we share your information with

We share personal information with service providers who help us operate our business, only to the extent needed for them to perform their role:

Shopify: our ecommerce platform, checkout and payment processing

Shopify Email: our email marketing platform

Gorgias: customer service and enquiry management

Yotpo: product reviews and ratings

Starshipit and New Zealand Post: order fulfilment and delivery

Afterpay and PayPal: where you choose those payment methods, transaction and contact details are provided to complete and assess the transaction under their own privacy terms

Google, Meta and TikTok: advertising and analytics, as described in clause 4

We do not sell your personal information.

We may also disclose personal information where we are required or permitted by law, to prevent a serious threat to life, health or safety, or in connection with the sale or restructure of our business.

6. Overseas disclosure

Some of the providers listed above store and process personal information outside New Zealand, primarily in the United States. Where we disclose your personal information overseas, we take reasonable steps to ensure the recipient is subject to privacy safeguards comparable to those in the Privacy Act 2020.

A current list of the providers we use and where they are located is available on request from our Privacy Officer.

7. Payment security

Payments are processed by Shopify Payments. Card details are entered directly into Shopify's payment systems and are not received or stored by us. Shopify maintains PCI DSS compliance for the payment infrastructure it provides.

Where you choose Afterpay or PayPal, payment is completed through that provider's own systems under their terms and privacy policy.

8. How we protect your information

We take reasonable steps to protect personal information from loss, misuse and unauthorised access. These include limiting access to personal information to those who need it for their role, relying on established platforms that maintain their own security controls, and reviewing access as staff and systems change.

No system is completely secure. If a privacy breach occurs that is likely to cause serious harm, we will notify affected individuals and the Office of the Privacy Commissioner as required by the Privacy Act 2020.

9. How long we keep it

We retain order and transaction records for at least seven years to meet our tax and legal obligations, and for longer where needed to support warranty claims on products with multi-year manufacturer warranties.

Marketing subscriber records are retained while you remain subscribed. If you unsubscribe, we retain a record of your unsubscribe request so that we do not contact you again.

Customer service correspondence is retained for as long as needed to resolve your enquiry and for a reasonable period afterwards.

10. Your rights

Under the Privacy Act 2020 you have the right to:

request access to the personal information we hold about you; and

request correction of that information if it is wrong.

To make a request, contact our Privacy Officer at privacy@explorerluggage.co.nz. We will respond within 20 working days.

You can unsubscribe from marketing emails at any time using the unsubscribe link in any email we send, or by contacting us.

If you believe we have breached your privacy, please contact our Privacy Officer in the first instance and we will investigate.

12. Changes to this policy

We may update this policy from time to time. The current version is always available on the Site.
