These Terms and Conditions govern your use of explorerluggage.co.nz (the Site) and any purchase you make from it. They should be read together with our Delivery, 100 Day Returns, Personalisation Terms and Privacy Policy pages, each of which forms part of these terms. By using the Site or placing an order you agree to be bound by them.

1. About us

Explorer Luggage is a trading name of EverMe Limited, a New Zealand company registered with the New Zealand Companies Office (company number 3790119, NZBN 9429030697720).

2. Placing an order

You may check out as a guest or sign in using Shop. An account is not required to purchase.

After placing an order you will receive an email acknowledging receipt. This acknowledgement is not acceptance of your order. Your order is an offer to buy, and a contract is formed only when we send you an email confirming that your order has been dispatched.

We may decline or cancel an order at our discretion, including where a product is unavailable, a pricing or product description error has occurred, or we are unable to verify payment or delivery details. If we cancel an order after payment has been taken, we will refund you in full.

Where an order contains multiple items, we are not obliged to supply any item until dispatch of that item has been confirmed.

3. Pricing

All prices are in New Zealand Dollars and include GST. Delivery charges, where they apply, are shown at checkout before you pay.

We may change prices and delivery charges at any time. Where a price changes after you place an order but before it is dispatched, we will contact you before processing it.

We take care with pricing and product information, but errors occur. Where an error is obvious and could reasonably have been recognised as an error, we are not obliged to supply at the incorrect price and will contact you with the option to proceed at the correct price or cancel for a full refund.

4. Payment

We accept payment by credit and debit card, PayPal, Shop Pay, Google Pay and Afterpay, processed through Shopify Payments.

Card payments are processed by Shopify. We do not receive or store your full card details. Shopify maintains PCI DSS compliance for the payment infrastructure it provides.

Afterpay and PayPal are provided by third parties under their own terms. Any payment plan, credit arrangement or dispute relating to those services is between you and that provider.

Payment is taken at the time your order is placed. Transactions will appear on your statement as EverMe Limited.

5. Delivery

We deliver within New Zealand only. We do not ship internationally from this Site.

Delivery options, timeframes and any charges are set out on our Delivery page. Timeframes are indicative and are not guaranteed delivery dates.

Risk in the products passes to you on delivery. Ownership passes to you when we have received payment in full, including any delivery charges.

6. Personalised products

Personalised products are subject to separate Personalisation Terms and Conditions. In particular, personalisation adds to dispatch time, and personalised items cannot be returned or exchanged for change of mind.

7. Returns, exchanges and faults

Change of mind returns are covered by our 100 Day Returns policy. Personalised items are excluded from that policy.

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where you purchase as a consumer. Where a product is faulty or does not meet the consumer guarantees, you are entitled to a remedy under that Act regardless of any other term on this Site.

Where you purchase for the purposes of a business, the Consumer Guarantees Act does not apply, and our liability is limited as set out in clause 11.

8. Gift cards

Gift cards are redeemable on explorerluggage.co.nz only and cannot be used on any other website or store we operate.

Gift cards expire three (3) years from the date of purchase.

Gift cards are not redeemable for cash and are not refundable or exchangeable, except where required by law. Where a purchase is less than the gift card balance, the remaining balance stays on the card and may be used on a later order until expiry.

We are not responsible for gift cards that are lost, stolen, or used without your authorisation.

9. Promotions and discount codes

Promotions, sales and discount codes are subject to any additional terms published with them, and to availability. Unless stated otherwise, discount codes cannot be combined with other offers, apply only to orders placed during the promotional period, and are not applied retrospectively to earlier orders.

We may withdraw or amend a promotion at any time before your order is accepted.

10. Use of the Site

You may use the Site for your own personal, non-commercial purposes. You must not:

copy, reproduce, republish or distribute content from the Site for commercial purposes;

attempt to gain unauthorised access to the Site, its servers or any connected system;

interfere with, disrupt or place undue load on the Site; or

use automated systems to scrape or harvest content or data from the Site.

Explorer Luggage is a trade mark of EverMe Limited. All content on the Site, including text, images, logos and design, is owned by or licensed to EverMe Limited and may not be used without our written permission.

11. Liability

To the extent permitted by law, and other than our obligations under the Consumer Guarantees Act 1993, we are not liable for any indirect or consequential loss arising from your use of the Site or from any product purchased through it.

Where we are liable and the law permits a limitation, our total liability will not exceed the amount you paid for the relevant product.

We do not guarantee that the Site will be uninterrupted or free of errors, and we are not liable for any failure or delay caused by events outside our reasonable control.

12. Privacy and marketing

We collect and handle personal information in accordance with our Privacy Policy and the Privacy Act 2020.

Where you have consented to receive marketing communications, you may unsubscribe at any time using the link in any email we send.

13. Governing law

These terms are governed by New Zealand law, and you and we submit to the non-exclusive jurisdiction of the New Zealand courts.

14. Changes to these terms

We may amend these terms from time to time. The terms applying to your order are those published on the Site at the time your order is placed.
